IMPORTANT SCOPE NOTICE

The Apache License applies ONLY to source code files made available under that License.

It does NOT apply to:
- Art assets, audio, music, or visual content
- World data, maps, terrain, balance, or procedural data
- Lore, narrative text, dialogue, or UI text
- BitCraft Online trademarks, logos, names, or branding
- BitCraft Online network services, servers, APIs, or live systems

Those materials are governed by the BitCraft Community License, the full text of which is copied below.

For the avoidance of doubt:
- Availability of open-source code does not grant use of the BitCraft Online trademark or any other trademark of Clockwork Laboratories, Inc.
- Availability of open-source code does not grant permission to operate a BitCraft service for commercial purposes
- Availability of open-source code does not grant permission to use BitCraft assets or branding

This License governs all non open-source aspects of BitCraft Online, including assets, intellectual property, trademarks, and network services.

### Definitions

“Licensor” means Clockwork Labs, Inc.

“BitCraft” means the BitCraft Online game, universe, and related products and services.

“Open Source Code” means source code licensed under the Apache License, Version 2.0.

“Assets” means all non source-code materials associated with BitCraft, including but not limited to:
- Visual art, textures, sprites, models, animations
- Audio, music, sound effects, voice content
- World data, maps, terrain data, procedural generation data
- Lore, narrative text, dialogue, story elements
- User interface text, localization files, icons
- Any derivative or modified versions thereof

“BitCraft Marks” means all trademarks, service marks, logos, names, trade dress, and branding associated with BitCraft, including but not limited to “BitCraft”, “BitCraft Online”, logos, faction names, and service names.

“Network Services” means all network-based services operated by Licensor, including official servers, APIs, matchmaking, authentication, telemetry, and live game data.

“You” or “Licensee” means any individual or entity exercising permissions under this License.

### Ownership and Reservation of Rights

All Assets, BitCraft Marks, and Network Services are owned exclusively by Licensor and are protected by copyright, trademark, and other intellectual property laws.

Except for the limited rights expressly granted in this License, no rights are granted, whether by implication, estoppel, or otherwise.

To the maximum extent permitted by applicable law, You waive and agree not to assert any moral rights or similar rights in connection with the Assets.

This License does not grant any patent rights.

### Relationship to Open Source Code

BitCraft Open Source Code is licensed separately under the Apache License, Version 2.0.

For the avoidance of doubt:

- This License does not apply to Open Source Code.
- The Apache License does not grant rights to Assets, BitCraft Marks, or Network Services.
- Availability of Open Source Code does not imply permission to operate a BitCraft service, use BitCraft assets, or use BitCraft branding for any commercial purposes.


### Limited License Grant (Assets)

Subject to the terms of this License, Licensor grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable, non-commercial license to:

- Use the Assets solely as integrated components of the official BitCraft client; and
- Modify the Assets solely for the purpose of creating non-commercial mods that function exclusively with the official BitCraft client and Network Services.

No other use of the Assets is permitted.

### Restrictions (Assets)

You may not:

- Use the Assets for any commercial purpose.
- Redistribute, sublicense, publish, or make the Assets available outside of official BitCraft distributions.
- Use the Assets to create a standalone game, competing experience, or substantially similar product.
- Use the Assets in advertising, marketing, or promotional materials.

These restrictions apply regardless of the license governing any underlying source code.

### Mods and User-Generated Content

Licensor may permit limited modding use of Assets provided that mods:

- Operate exclusively with official BitCraft clients and Network Services.
- Are distributed free of charge.
- Do not redistribute Assets independently.
- Do not imply official endorsement.

Licensor may revoke modding permissions at any time.

### Trademarks

Nothing in this License grants permission to use BitCraft Marks.

You may not:

- Name or brand any product, server, fork, or service using BitCraft Marks.
- Register domain names, applications, or social media accounts using BitCraft Marks or confusingly similar names.
- Imply affiliation with or endorsement by Licensor.

You may use BitCraft Marks solely for factual, descriptive purposes, such as: “Built using the BitCraft Open-source engine” provided such use is truthful, non-misleading, non-prominent, and does not use logos or branding.

Only Licensor-operated services may be described as “Official BitCraft” services.

Trademark rights exist independently of this License.

### Network Services

Network Services are not open source and are provided solely at Licensor’s discretion.

Nothing in this License grants the right to:

- Access production Network Services without authorization.
- Operate or emulate BitCraft servers.
- Represent any service as official or affiliated.
- Use BitCraft Assets or world data in private or third-party server environments in any commercial capacity.

Licensor may impose access controls, rate limits, or additional terms at any time.

### Suspension and Termination

This License and any permissions granted hereunder terminate automatically upon any breach.

Licensor may suspend or terminate access to Network Services at any time, with or without notice.

Upon termination, You must immediately cease all use of Assets, BitCraft Marks, and Network Services and destroy all copies of Assets in Your possession or control.

### Disclaimer of Warranty

All Assets and Network Services are provided “as is” and “as available”, without warranties or conditions of any kind.

### Limitation of Liability

To the maximum extent permitted by law, Licensor shall not be liable for any damages arising out of or relating to this License, the Assets, or the Network Services.

### Equitable Relief

You acknowledge that unauthorized use of Assets, BitCraft Marks, or Network Services would cause irreparable harm. Licensor is entitled to seek injunctive or equitable relief without posting bond.

### Governing Law and Venue

This License shall be governed by the laws of the jurisdiction of Licensor’s principal place of business. Any legal action shall be brought exclusively in courts located therein.

### Severability

If any provision of this License is held unenforceable, the remaining provisions shall remain in full force and effect.
